What if we don't live in Utah?
Good news! You are NOT required to live or reside in Utah. Recent changes in Utah law allow non-resident couples to file for divorce in Utah if both spouses signed an affidavit consenting to Utah's personal jurisdiction for divorce or annulment. Since all Utah County-issued online marriage licenses require this affidavit, you and your partner should have already completed it. See: Utah Code § 81-2-303(5)(a)(ii) – personal jurisdiction (read code here).
Effective September 1, 2024, Utah Code § 81-4-402(1)(c) confirms that couples who have consented to personal jurisdiction are eligible to file for divorce in Utah, even if neither party resides in the state (read code here).
